1. These Terms and Conditions apply to the use of Path to Words at pathtowords.com as a web app and installable Progressive Web App.
2. The provider and contracting party is Leo Köpke, Nernstweg 6, 22765 Hamburg, Germany, email info@pathtowords.com.
3. Path to Words is primarily intended for consumers. Mandatory consumer protection rules of the country in which a consumer has their habitual residence remain unaffected.
4. A user's conflicting terms only apply if Leo Köpke has expressly accepted them.
1. Path to Words is a digital vocabulary trainer using a spaced repetition algorithm. The service includes curated vocabulary packs for several languages and CEFR levels A1 to C2, custom words and lists, read-aloud audio, AI-generated example sentences and the import of custom vocabulary lists.
2. Supported imports include files from Anki, Excel and CSV. If a file format is unclear, a small sample of the file may be classified by an AI service.
3. The app interface is available in German, English, French, Spanish, Arabic and Turkish. The learning languages, vocabulary packs and levels currently available are shown in the current product description.
4. AI-generated audio and example sentences are provided as learning aids. They may contain errors or unnatural phrasing. Path to Words does not promise a particular learning, examination or professional outcome.
5. Statutory rules governing digital products, including statutory rights relating to failure to supply, lack of conformity, updates and modifications, remain unaffected.
1. An account is required for personalised learning functions.
2. Regular use is intended for people aged 16 or over. Anyone under 16 may only use Path to Words with the consent of a parent or guardian.
3. A minor entering into a paid contract requires any consent from their legal representative that is required by law, unless the contract is already effective under the applicable statutory rules without that consent.
4. Registration information must be accurate and kept up to date. The account is personal and must not be sold, transferred, rented or permanently made available to another person.
5. Sign-in credentials must be kept confidential. The user must inform Path to Words without undue delay if unauthorised access is suspected.
6. A person must not use multiple accounts to circumvent plan limits, safeguards or usage restrictions.

3. Internal per-account feature counters are used to calculate these allowances.
4. Free accounts may be deleted after three years of inactivity. Two warning emails are sent to the registered email address first. Use of the account during the warning period prevents deletion. Lifetime accounts are excluded from inactivity deletion.
1. All prices are final prices. In accordance with Sec. 19 of the German VAT Act (UStG), no VAT is charged or itemised.
2. Monthly Premium costs €6.99 per month. The contract term is one month. It renews for successive one-month periods and may be cancelled at any time with effect from the end of the current monthly billing period.
3. Annual Premium costs €49.99 for the first twelve months. This amount is paid in advance at the beginning of the initial term. After those first twelve months, the contract continues indefinitely as a monthly subscription at €6.99 per month. From that point, it may be cancelled at any time with effect from the end of the current monthly billing period.
4. The user will receive a reminder email in good time before the annual plan changes to monthly continuation.
5. Lifetime costs a single payment of €149. It is not a subscription and no further recurring payments are charged for this plan.
1. The display of plans is an invitation to make an offer. The user submits a binding offer by using the appropriately labelled order button at checkout.
2. Before ordering, the plan, price, term, renewal rule and key service features are displayed. The annual plan expressly states that, after the first twelve months, it continues indefinitely at €6.99 per month.
3. The contract is formed when the purchase is confirmed and the selected plan is activated.
4. Payments are processed by Stripe through a hosted checkout. Available payment methods, including card and PayPal, are displayed at checkout.
5. Stripe creates and sends invoices and payment receipts separately.
6. The user must ensure sufficient funds and accurate payment details. If a renewal payment fails, Path to Words may make further payment attempts and ask the user to update or confirm payment. Statutory rights remain unaffected.
1. Premium is normally activated immediately after successful contract formation.
2. At checkout, a consumer may expressly request that Path to Words begins performance before the fourteen-day withdrawal period ends. The consumer also acknowledges that the right of withdrawal ends once the service has been fully performed.
3. If the consumer withdraws after requesting early performance but before the service has been fully performed, the consumer may have to pay a reasonable proportionate amount for the service supplied up to withdrawal.

1. Monthly Premium may be cancelled at any time with effect from the end of the current monthly period.
2. Annual Premium may be cancelled during the initial twelve months with effect from the end of that initial term. If it is not cancelled, it then continues indefinitely at €6.99 per month. During this monthly continuation, it may be cancelled at any time with effect from the end of the current monthly period.
3. Cancellation can be submitted through the statutory two-step cancellation process in the settings. Other methods permitted by law remain available.
4. After ordinary cancellation, Premium remains active until the confirmed contract end date. The account then changes automatically to Free. Learning progress, custom words, lists and notes remain available to the extent permitted by the Free limits. Content above the Free limits is not deleted and remains usable; only the creation of new content above the respective limits requires Premium to be reactivated.
5. The right to terminate for cause remains unaffected.
1. Lifetime gives the entitled person access to the relevant Premium feature set for the lifetime of the Path to Words service. Lifetime does not refer to the user's lifetime and is not a promise that the service will operate indefinitely.
2. The Lifetime entitlement is personal, non-transferable and must not be traded. The account and entitlement must not be sold, gifted, rented or permanently made available to another person.
3. Lifetime covers the Premium feature set as it lawfully develops over the life of the service. It does not include separate products or services introduced later that are clearly offered independently and are not part of Path to Words Premium.
4. If Path to Words is permanently discontinued, Lifetime access ends when the service ends. Where practically and legally possible, the user will receive reasonable advance notice and an opportunity to request or export their data. Statutory claims arising from the discontinuation remain unaffected.
5. Lifetime accounts are not deleted for inactivity. Account deletion requested by the user will, however, also end the Lifetime entitlement. The user will be clearly informed of this before deletion.
1. When changing from Monthly Premium to Annual Premium, any unused pro rata credit from the current monthly period is applied. The remaining difference to the annual price is due immediately. The twelve-month initial term of the annual plan starts when the change is completed.
2. When changing from Monthly or Annual Premium to Lifetime, any unused credit is applied directly at checkout. The previous subscription ends when the Lifetime purchase is successfully completed.
3. Before a plan change is completed, the price, credit, amount due immediately and new term rule are displayed.
1. Users may provide custom words, lists, notes and import files. Rights in that content remain with the user or the relevant rights holder.
2. The user confirms that they hold the necessary rights and that the content does not infringe third-party rights, applicable law or these Terms.
3. The user grants Leo Köpke a non-exclusive licence, limited to the contract term and the technical purpose of supplying the service, to store, reproduce, technically convert, display and process the content where required for import, synchronisation, backup, learning functions and other contractual supply.
4. This licence does not permit use for advertising, the sale of user data or publication to other users.
5. Infringing or otherwise unlawful content can be reported to info@pathtowords.com or through pathtowords.com/kontakt. A report should identify the content, explain the objection and provide enough information for review.
6. Path to Words may restrict or remove content where there are specific indications of infringement or breach of these Terms. Unless immediate action is required to prevent harm, the affected user will be informed before the measure or without undue delay afterwards and given an opportunity to respond.
7. Statutory rights relating to the return or supply of user-generated content after contract termination remain unaffected.
The user may only use Path to Words lawfully and in accordance with the contract. In particular, the user must not:
1. Infringe third-party rights or upload unlawful content.
2. Introduce malware, automated attacks or other harmful technical content.
3. Circumvent security mechanisms, access controls, plan limits or allowances.
4. Scrape, systematically copy or materially overload the service without permission.
5. Resell content or access commercially or offer it to third parties as the user's own service.
6. Transfer an account or Lifetime entitlement or permanently make it available to another person.
7. Use the service to harass, deceive, register accounts abusively or otherwise harm others.
1. The software, design, curated vocabulary packs, database structures, trade marks, text, graphics and other elements of Path to Words are legally protected.
2. For the contract term, the user receives a personal, non-exclusive and non-transferable right to use the service within the selected plan.
3. Any further copying, modification, distribution, making available to the public, decompilation or commercial exploitation is only permitted where allowed by law or expressly authorised.
1. Path to Words aims to provide high availability. Continuous or entirely error-free availability cannot be technically guaranteed.
2. Temporary restrictions may arise from maintenance, security measures, network or provider failures and events outside reasonable control.
3. Required updates, including security updates, are supplied during the applicable supply period. Users must install reasonable browser, operating system or PWA component updates where they have been informed of the update and the consequences of not installing it.
4. Statutory rights arising from non-conforming supply remain unaffected.
1. Path to Words may modify the service during ongoing supply where there is a valid reason. Valid reasons include technical development, improved security and usability, compliance with legal requirements, prevention of abuse and adaptation to changed technical interfaces or service providers.
2. A modification does not create additional charges unless the user voluntarily selects another plan or a separate additional service.
3. Users will receive clear and understandable information about modifications. Where a modification impairs access or usability by more than a minor extent, information will be provided on a durable medium within a reasonable period before the modification. Statutory rights, including any right to terminate without charge, remain unaffected.
4. Material core features of a paid plan will not be removed without a valid reason.
1. Path to Words may temporarily suspend individual functions or an account where there are specific indications of a serious breach, security risk, abusive use or failure to meet a payment obligation.
2. Measures must be proportionate. Where possible, the user will be informed in advance of the reason and any available remedy. In an urgent situation, the information may be provided afterwards.
3. Permanent termination for cause generally requires a prior warning or reasonable opportunity to remedy the breach, unless this would be unreasonable due to the seriousness of the breach or particular circumstances.
4. Statutory rights relating to payment, conformity, refund and damages remain unaffected.
1. Leo Köpke has unlimited liability for intent and gross negligence, culpable injury to life, body or health, liability under the German Product Liability Act, an expressly assumed guarantee and any other mandatory statutory liability.
2. For a slightly negligent breach of an essential contractual obligation, liability is limited to the loss typical for the contract and foreseeable when the contract was formed. Essential contractual obligations are obligations whose performance is necessary for proper performance of the contract and on which the user may normally rely.
3. Liability for slight negligence is otherwise excluded.
4. These limitations apply correspondingly to legal representatives and agents.
5. The user remains responsible for reasonable personal backups of exportable content where a backup function is provided. This does not limit any statutory duty of Path to Words to supply, preserve or return data.
1. The user can request account deletion in the settings. A 30-day grace period applies, during which deletion can be cancelled.
2. An active subscription is ended before final deletion. Deletion of a Lifetime account also ends the Lifetime entitlement.
3. After final deletion, words, lists, notes, learning progress and other account content are deleted unless a statutory retention duty applies.
4. Invoice and payment data subject to statutory retention remains stored for the relevant period.
5. A data export can be requested through the contact form before final deletion.
1. The German version of these Terms is the legally controlling version.
2. The English version is provided as a translation and aid to understanding. If there is a conflict or difference in interpretation, the German version prevails to the extent permitted by law.
1. German law applies, excluding the United Nations Convention on Contracts for the International Sale of Goods. For consumers, this choice of law only applies to the extent that it does not deprive them of mandatory protection under the law of their country of habitual residence.
2. If the user is a merchant, a legal entity under public law or a special fund under public law, Hamburg is the place of jurisdiction where permitted by law.
3. Statutory rights relating to alternative dispute resolution remain unaffected. The provider is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
4. If an individual provision is or becomes ineffective, the remaining provisions remain effective. The statutory rule applies in place of the ineffective provision. The same applies to an unintended omission.
